4. Definitions
The data protection declaration is based on the terms used in the UK-GDPR and the Data Protection Act 2018. Our data protection declaration should be easy to read and understand for the public as well as for our customers and business partners. 4. Restriction of processing
Restriction of processing is the marking of stored personal data with the aim of limiting its future processing.
5. Profiling
Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
6. Pseudonymisation
Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
7. Processor
Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
8. Recipient
Recipient is a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular enquiry in accordance with Union or Member State law shall not be regarded as recipients.
9. Third party
A third party is a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or processor, are authorised to process the personal data.
10. Consent
Consent is any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
5. Legal Basis of the Processing
Art. 6 para. 1 lit. a UK-GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose.
If the processing of personal data is necessary for the fulfilment of a contract to which you are a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 para. 1 lit. b UK-GDPR. The same applies to such processing operations that are necessary for the performance of pre-contractual measures, for example in cases of enquiries about our products or services.
If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Art. 6 para. 1 lit. c UK-GDPR.
In rare cases, the processing of personal data may become necessary in order to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured on our premises and their name, age, health insurance details or other vital information would have to be passed on to a doctor, hospital or other third party. The processing would then be based on Art. 6 para. 1 lit. d UK-GDPR .
Ultimately, processing operations could be based on Art. 6 para. 1 lit. f) UK-GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
Our services are generally aimed at adults. Persons under the age of 16 may not transmit any personal data to us without the consent of their parents or legal guardians. We do not request personal data from children and young people, do not collect it and do not pass it on to third parties.
6. Transmission of Data to Third Parties
Your personal data will not be transferred to third parties for purposes other than those listed below.
We only pass on your personal data to third parties if:

3. in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 lit. c) UK-GDPR, and
4. this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 lit. b) UK-GDPR.
As part of the processing operations described in this Privacy Policy, personal data may be transferred to the USA if one of the following conditions is met:
1. Standard Contractual Clauses (SCCs) with supplementary measures
Companies can use the standard contractual clauses provided by the UK ICO or EU standard contractual clauses (Art. 46 UK-GDPR). In doing so, they must check and document whether the data protection standard in the USA is effectively protected by supplementary measures (e.g. additional encryption, pseudonymised processing, contractual guarantees against access by authorities).
2. Binding Corporate Rules (BCRs)
Multinational corporations can be certified via internally binding corporate rules (BCRs). As soon as the UK ICO has approved these BCRs for the entire group of companies, transfers within the group to the USA are covered.
3. Consent (Art. 49 para. 1 lit. a UK-GDPR)
A transfer is also possible if the data subject has given explicit and informed consent. Consent must comply with the information requirements and be revocable at any time.
4. Exceptional circumstances (Art. 49 UK-GDPR)
Contract fulfilment: If the transfer is necessary for the fulfilment of a contract with the data subject
Important public interests: e.g. in urgent health or safety cases.
Legal claims: For the establishment, exercise or defence of legal claims.
5. US-specific certification programmes
Some US providers can certify themselves in accordance with UK ICO requirements (e.g. under the new UK-US Data Access Agreement), which restricts certain data access rights of US authorities and facilitates transfer.
7. Technology
7.1 SSL/TLS Encryption
This site uses SSL or TLS encryption to ensure the security of data processing and to protect the transmission of confidential content, such as orders, login data or contact enquiries that you send to us as the operator. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.
The legal basis for data processing is Art. 6 para. 1 lit. f) UK-GDPR. Our legitimate interest follows from the data collection purposes listed above.
7.3 Cloudflare (content delivery network)
Our website uses functions of CloudFlare. The provider is CloudFlare, Inc. 665 3rd St. #200, San Francisco, CA 94107, USA.
CloudFlare offers a globally distributed content delivery network with DNS. Technically, the transfer of information between your browser and our website is routed via the CloudFlare network. CloudFlare is therefore able to analyse the data traffic between users and our websites in order to detect and ward off attacks on our services, for example. CloudFlare may also store cookies on your computer for optimisation and analysis purposes.

The personal data is stored for as long as it is required to fulfil the purpose of processing. The data will be deleted as soon as it is no longer required to fulfil the purpose.
This US company is certified under the EU-US Data Privacy Framework. This constitutes an adequacy decision pursuant to Art. 45 UK-GDPR, meaning that personal data may be transferred without further guarantees or additional measures.

8. Cookies
8.1 General information on cookies

9. Contents of our website
9.1 Data processing when opening a customer account and for contract processing
In accordance with Art. 6 para. 1 lit. b) UK-GDPR, personal data is collected and processed if you provide it to us for the execution of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. It is possible to delete your customer account at any time, for example by sending a message to the above address of the controller. We store and use the data provided by you to fulfil the contract. 9.3 Application management / job exchange
We collect and process the personal data of applicants for the purpose of handling the application process. Processing may also be carried out electronically. This is particularly the case if an applicant submits the relevant application documents to us electronically, for example by e-mail or via a web form on the website. If we conclude an employment or service contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions.
